Patent Law Basics

Wednesday, October 6th, 2010

Though you surely know what a patent is, it is likely that you don’t know what patent law is or entails, or why it is so important today. Patent law protects a special type of property: intellectual property. Intellectual property includes, as the name implies, thoughts, inventions, and other original ideas created by an individual or company. These thoughts are turned into tangible objects in most cases that are then patented. A patent is a government issued right that asserts that individuals who create an invention benefit solely from it for a specific period of time. After that time is up, anyone can copy the patented item. With patent law infringement, an inventor or company risks losing out on potential profits.

The two most popular defenses to patent infringement are that the patent is invalid, or that the products being made or sold do not infringe the patent in question. Even if you are already familiar with patent law, it is important to hire an attorney that deals exclusively with patent law if you are going to be spending any time fighting a copyright infringement case.

Though intellectual property does carry with it some unique attributes, the trading of it is not one of them. Just like any other property, intellectual property including copyrights and patents can be traded, sold, exchanged, or even abandoned if that’s what the owner decides to do. Copyright law is a form of intellectual property law, and this is where patent law comes from.

Insuring Yourself Against Patent Trolls in Texas

Tuesday, September 28th, 2010

You are probably aware of the rising popularity of patent trolls in Texas if you have a company that is at risk of infringing on a copyright. Simply put, almost no company is surely safe from patent trolls in Texas who seek out profitable entities and threaten them with copyright infringement lawsuits.

While most companies opt to settle with the patent troll instead of going to court and risking millions of dollars as well as losing, the settlement amount can still put the company into financial trouble.

This is where intellectual property insurance comes in. With intellectual property insurance, the policy holder doesn’t have to worry about the possible threat of a copyright infringement lawsuit because the insurance company will pay for the defense as well as a certain percent of the settlement, depending on the particular policy. Although, like any insurance plan, intellectual property insurance does add to overhead, it can be an absolute necessity when facing a Texas patent troll.

Another type of intellectual property insurance protects the company from another company or individual infringing on their patent. With this policy, the insurance company pays for the cost of taking the accused infringer to court.

With the art of patent trolling on the rise in the Texas area, it is especially important to consider the threat of a copyright lawsuit and what you can do to prevent your company from suffering when it does happen. Insuring yourself against Texas patent trolls is a great preventative measure.

Copyright Law Basics

Monday, September 27th, 2010

Copyright law is a branch of intellectual property law. A copyright provides legal protection for original works of authorship which are fixed in a tangible form. Intellectual works that are subject to copyright protection include literary, musical, and dramatic works, as well as photographs and graphics, audio and visual recordings, and software.

In order for the work to be fixed in a tangible form, the creation must have been set in a form which can be perceived either directly or with the aid of a device. For a literary work this could be when it is first created on a computer or paper. For a musical work it could be either the phonographic recording or the sheet music. An idea itself does not have copyright protection. The idea must be fixed in a tangible form for copyright protection to be created.

The owner of a copyright has the exclusive right to control the production, distribution,  and performance of the work as well as the preparation of derivative works. Original ownership of the copyright is granted to the author of the work, with a couple of exceptions. If the author creates the work as part of his or her employment responsibilities, then the employer is considered to be the author under the work for hire doctrine.

Ownership of a copyright can be transferred. A transfer of the owner’s exclusive rights must be made in writing. A transfer of less than the owner’s exclusive rights does not need to be in writing.

Patent Law Attorneys in Tyler TX

Wednesday, September 15th, 2010

Tyler has the unfortunate fame for being a place patent troll companies set up offices in.

The way this all works is based on the premise that a Tyler Texas jury is more likely to side in a lawsuit with a patent troll rather than the large company being sued.

For instance, recently a lawsuit was won by a patent troll company that set up an office in town against Microsoft.

The jury awarded the patent troll 25 million dollars or so.

So what is a patent troll and what makes them wrong? A patent troll company is a company that buys patents from companies who have never used their patent to make anything.

The patent troll company also chooses to not make anything with the patent however they are willing to sue anyone who may have infringed on the patent as a business model.

So the only reason the patent troll company buys a patent is to turn around and sue any large company that may have infringed on the patent.

In Tyler Texas patent trolls have had amazing success at pursuing the lawsuit in court through a jury trial.

The only way that a patent troll can sue say, Microsoft in the city of Tyler is to set up an office physically in the city of Tyler Texas.

They than have a statistical advantage of the jury siding with the patent troll and awarding a very large penalty dollar amount.

It is not uncommon for a patent infringement lawsuit to pay out 10 million dollars and more when being tried in a Tyler Texas court room.

So what does this say about our citizens that sit on juries in Tyler courts? Are we stupid? Do we not understand the scam?

The patent troll has not nor will ever actually produce anything valuable with the patent and they never plan to yet they make a millionaires income from these lawsuits and Tyler Texas citizens help to make their American dream come true however under handed it may be.

East TX State Fair

Tuesday, September 14th, 2010

The East Texas State Fair offers fair food, rides, and a bunch of local business booths that give a lot of free junk a way.

There is much more to the East Texas State Fair than the above.

If you go to their official website and write down the schedules of the singing shows, farmers market, and livestock show you will get a good taste of some of what East Texas is all about.

I want to strongly urge you to stay away from the turkey legs. They are nothing more than turkey jerky by the time you get to them.

Also of you are a desperate girl in need of a relationship do not run off with a carni. This behavior always ends like in the movie, “The Jerk”.

Finally if you get motion sick at all keep away from any fast moving rides especially if you have eaten any fair food prior.
